Com. Fidel Castro is no more. He expired yesterday at the age of 90. About 45 years ago the American government and American media spread a rumour that Castro died due to heart attack.Then, Fidel declared;
“I have a heart of steel.” He proved it.He was not an ordinary leader, not an ordinary politician.
Cuba has the highest population of elderly people. 20% of Cubans are above the age of 60 years.It will increase to 30% soon.In America, the elders get free healthcare etc. There are lot of facilities for them.But, they lack one thing: Company of their children and grand children. Elderly people are left alone. Loneliness creates many a problems to them. In most of the Latin American countries the elderly people are not cared for.
In Cuba, the elderly people stay with their children.Fidel Castro told the new generation; “They are not living in your houses.You are living in their Homes”. The Cuban Delegate to Barcelona conference of Trade Union International (PR) told:
“In Cuba, the government ensures social security to all. Monthly pension is guaranteed. Good relationship prevails between the workers and pensioners.Ministry of Culture has created a university for senior citizens….” [Page 25 of Pensioners Patrika No 14.]
It is because of Com. Fidel Castro.

Soon after the Special Conference, CHQ swiftly moved. Comrades G Natarajan (GS), D Gopalakrishnan (VP), G Babu (VP) and R Chengappa went to New Delhi. Comrades R C Malhotra (AGS), R L Kapoor (Legal Committee Member and President of HQr branch) and Anupam Kaul (Secretary, HQr Branch, New Delhi) joined them. The team had several meetings and discussions in New Delhi on 23rd and 24th November 2016. They met Joint Secretary, Department of Telecom, Member (Finance), Member(Services), DDG (Estt), Director (Estt) as well as Officers in Department of Pension & Pensioners Welfare.
Following issues were taken up:
1. Future Pension Revision with the fitment formula suggested by 7th CPC.
2. Slow process on 78.2% in Circles.
3. Grant of Pension reckoning Extra Increment:
4. Delinking of 33 years of service for grant of full pension to all who retired from BSNL prior to 1-1-2006.
5. Holding Pension Adalat at national level.
Our Impression:
Some of the officers have not yet thought of the issues seriously.They were impressed upon the need to do it soon. We have laid the foundation.On behalf of our Association we gave detailed letters on the above issues to all concerned. CHQ assures consistent vigorous efforts to settle the issues.
Future Pension Revision with CPC fitment benefit:
Generally, the top officers are not averse to the proposal. It is pointed out that the PRCshall not propose any pension revision for the central PSUs, or exclusively for BSNL. DDG raised the doubt whether an anomaly may not arise where the people who retire after 1-1-2017 may be at a disadvantageous position compared to those who retired before that date and got the benefit of CPC report. We told that it would not happen as serving staff may get a pay revision with effect from 1-1-2017. Director (EStt) assured that she would study the issue in depth and initiate suitable action.Joint Secretary also assured that he would examine the matter thoroughly. I hope that the matter will get due attention of the DOT. We demanded DOT endorsement of DOP&PW OM on increased gratuity, Minimum pension etc. The file is pending with finance now and officers assured that it would be expedited.
Work on 78.2% case:
We pointed out that in most of the Circles the work is very slow and sluggish. Member (S) wanted specific cases and next day we gave a list to both Member(S) and Member(F). They assured that necessary action would be taken.
Extra Increment case
We pointed out that the five pensioners who approached the CAT Ernakulam and got favourable judgement are granted the benefit.Similarly placed pensioners of other circles should also be given the benefit as the AIBSNLPWA is the first applicant in the case. Member(S) assured due action.
Full Pension on 10 years of qualifying service:
It was told that a detailed Note is being sent again to DoP&PW seeking a clarification on the matter.But, later,the officer in DoP&PW told us that it is for DoT to decide the case as DoT only issued order for the pension revision and DoP&PW is not issuing orders regarding IDA pensioners.
Pension Adalat:
We pointed out to Member (F) that his predecessor had told us that a decision was taken and the pension Adalat would be held soon at national level.But it did not happen so far. M(F) agreed to examine it.

Com. D Gopalakrishnan and myself will be attending the Asia Regional Conference of Trade Union International (Pensioners and Retirees) on 3-12-2016 at Kathmandu, Nepal.

 Com. Rk is Convalescing
Com R. Krishnamoorthy, our member and Ex Circle Secretary NFTE, Tamilnadu  has undergone a minor cancer operation on 18-11-16 at Appollo Cancer Hospital, Teynampet, Chennai.

Our comrades N. Kothandaraman and S. Sivasankaran were at the hospital during the operation.  The operation is successful and he is improving well.

Doctors had advised that he needs a  lot of rest and phone enquiries and personnel visits by friends should be avoided for 2 months to avoid infection to him. It is the personnel request by his family also.

Hence we request our members and other comrades of Tamilnadu also to cooperate with the situation by not calling or visiting him for some time.
We wish him to get well soon.

Dear Comrades,
Greetings to all. 
One day special meeting to felicitate Hon.Minister Ananthkumar ji was a grand success. More than 100 comrades had attended the glorious meeting from Tamilnadu itself.
Minister came straight from the airport to attend our meeting.. A warm welcome was given to him. A mind blowing and heart touching felicitation speech with beautiful narration of  the incidences by Com DG was the highlight of the meeting. In his speech he has put up our demand of Pension Fixation at par with 7th CPC and he justified our demand also beautifully and logically. He on behalf of our association sought the help of the minister. Really it was a wonderful and mind blowing moments then. The minsiter was much moved and over whelmed.
Minister Ananth kumar ji  in his address told that he was a son of a trade union leader of Railway Employees. So he respected our feelings and demands. He informed that he would be ready to help us as he had done earlier and had told our leaders to meet him in Newdelhi.
Com DG thanked the minister immediately for his assurance for help and we would definitely achieve our pension revision and further a fitting Felicitation meeting would be conducted for the Minister in some other place with more comrades will attend the meeting.
In this way the special conference ended with National anthem.

8.2% Position in Kovai District                  
Dear Comrades,

In our Division, regarding 78.2% IDA arrears,  Calculation for all the 1100 files of Post 2007 and All the 650 files of Pre 2007 are over.

All files will be sent to CCA Tamilnadu thro Logistics post parcels very shortly.

At this juncture, it is to me mentioned that Madurai SSA is very very far ahead of others in the race. More than 322 pensioners have received Sanction Memos and 25 to 30 pensioners have received the arrears amount through Indian Bank on 5th November itself. Arrears credit work in State bank of India and in Post Office are going on.

CCA informed in the Pension Adalat that 1000 files have been cleared and orders sent. In that 800 files belong to Pre 2007  and 200 to Post 2007 Categories.
Let us hope the best to receive our arrears at the earliest.

All India CWC meeting will be conducted in Bangalore on 12th and 13th of November 2016. 

A Grand Victory Celebration  meeting for 78.2% IDA pension revision will be held on 12th saturday evening at 4 PM.

Honourable Central Minister shri. Ananthakumar ji who had helped us in many a ways to achieve this and also in removal of  60:40 formula has accepted our invitation  and confirmed his participation in our Victory Day celebration Meeting on 12th November saturday 2016 at " sheesh Mahal Palace Grounds, Bangaluru.( It is at a distance of just one KM from Bengaluru Contonment Railway Station.)
In the recently concluded Tamilnadu Circle Conference at Coimbatore we had requested our comrades of all SSAs of TN to attend the Victory Day Meeting in enmasse .

Breakfast and lunch for all comrades attending the Special conference has been arranged at the venue of the conference ( Sheesh Mahal, Palace grounds).

26th Pension Adalat at Chennai

26th Pension Adalat of Tamilnadu was held at Chennai on 7/11/2016 after a gap of 8 months under the chairmanship of new CCA Dr R.Niranjana.  Joint CCA Shri Vinod Kumar welcomed all.  On behalf of pensioners Com DG welcomed all.  Representatives from some banks like SBI, IOB, Canarabank and representatives from BSNL Tamilnadu Circle, Chennai Telephones, STR, STP and representatives from O/o GM, PA&F attended.  It was held between 1415 & 1745 (3hrs & 30mts).

49 individuals have represented their grievances (nearly 15 about change of address).  Out of 49, twentyfour grievances were settled; 15 are pending due to wants of information; 4 are pending with Banks & 6 are closed. 

On behalf of 11 pensioners’ associations (out of which 7 are from AIBSNLPWA – TN Circle, Chennai Telephones, Madurai, Tirunelveli, Coimbatore, Thanjavur & STR SSAs) 122 cases were given.  The other 4 associations were AIBDPA TN circle, and its Vellore SSA unit, Trichy & Erode Associations.  From these Associations, Trichy, Erode &Vellore were not present.  From our Association, our GS, Vice president DG, CHQ treasurer, TN circle president, Circle Secretary, Chennai Telephones President, Secretary, Treasurer & others, representatives from Cuddalore, Puducherry, Thanjavur, Madurai, Tirunelveli, Virudhunagar SSAs attended the pension adalat.

Many issues were settled and some of the issues still remain unsettled.  Some of the following common issues were discussed.

1.      Grant of 3% increment on promotion instead of one increment in the lower gradeSince clarificatory orders are received, the cases would be settled provided SSA units forward the sanction and Service Book of the concerned official.

2.      Reckoning officiating pay for pension The official side informed that It was denied on the basis of some order issued by Corporate office and clarification is sought and the clarification is still awaited.  We raised the following points a) As per statutory rule, officiating pay is to be reckoned for pension, b) The corporate office withdrew that order at a later date, c) Whether CCA office is guided by Corporate office order or DoT order/statutory rule.  CCA informed that we can have a separate discussion on this issue.
3.      Reckoning Extra increment for pension The official side informed that they have sought clarification from DoT on the subject and it is still awaited.  CCA wanted our HQrs to pursue at DoT level to get necessary clarification from Establishment wing of DoT.  We informed that hundreds of cases were settled in Tamilnadu and only few cases remain unsettled.  DoT issued orders on 27/7/2009 stating “competent authority has approved the counting one extra increment granted to Gr.III staff of BSNL …. Towards pension & pensionary benefits as a special case as this issue had been a part of wage settlement”.  This order was neither withdrawn nor modified by DoT.  Further as per DoT orders, OTBP/BCR is allowed for restructured cadres.  CCA informed that we can have a separate discussion on this issue.

4.      Grant of full pension for those who retired prior to 1/1/2006 having less than 33 years of qualifying serviceThe official side informed that nearly 650 cases of CDA pensioners were settled.  On a querry from us, the official side informed that it covers both minimum pension and others who  got pension above the minimum of revised pay + GP but proportionate pension (i.e. those who were covered as per para 4.1 & para 4.2).  The official side informed that they have not issued revised authority for BSNL IDA pensioners.  They informed that there is no grade pay in BSNL and

hence they are not in a position to apply 6/4/2016 order of DoP&PW for them and they have sought the clarification from DoT.  We told that the table, the official side was referring to, was an annexure attached to 28/1/2013 DoP & PW order.  That order speaks about only the minimum pension.  Para 5 of that order mentions about para 4.1 & 4.2 (of OM dated 1/9/2008) and pro-rata pension for those having less than 33 years of service.  This particular para was deleted by DoP & PW order dated 6/4/2016.  Then the official side raised a basic doubt that whether 6/4/2016 order of DoP & PW covers BSNL IDA pensioners also.  We raised a question whether BSNL IDA pensioners who retired after 1/1/2006 having less than 33 years of qualifying service were given full pension or not?  The official side informed that they were not also given.  We challenged it and informed that full pension was given to them since the concept of 33 years of qualifying service for full pension was dispensed with and the CCS (Pension) rules was amended accordingly.  We told that DoT & BSNL Corporate office endorsed that order of DoP & PW.  We quoted para 7(a) of DoP & PW OM dated 1/9/2008 which stated “Govt. servants on permanent absorption in PSU continue to draw pension separately from the Govt, the pension of such absorbees will be updated in terms of these orders”.   Further, we quoted DoT’s clarificatory order dated 3/6/2016 which stated “Therefore, all pre-2006 pensioners, except those mentioned at point (ii) below are eligible for revision of pension in terms of OM dt.6.4.2016”.  We also told that the existence of an order from the Ministry of Human Resources.  After hearing our arguments patiently, CCA informed that he is willing to discuss this issue separately with an open mind irrespective of the clarification sought.  He wanted a letter from us quoting the orders which we mentioned during the course of argument.  We have agreed for the same.
